Vybz Kartel Trial Day 4: Prosecution & Defense Argue Over Evidence Act

Vybz Kartel returns to the Home Circuit court today for day four of his high profile murder trial.

Yesterday Justice Bryan Sykes asked the jury to be absent from court until next Tuesday. Over the next three court dates Sykes will hear arguments from both the prosecution and defense regarding a motion filed by prosecutors to have a witness statement be entered into evidence.

The prosecution says they are unable to locate the witness and is asking the judge to enter a previous statement made by said witness into evidence under section 31(D) of the Evidence Act.

Justice Sykes is expected to hand down a ruling on that motion by Monday. The judge ruling could prove crucial to the outcome of the high profile murder case.

Vybz Kartel, born Adidja Palmer, was arrested in September 2011 and charged with the murders of Barrington “Bossie” Burton and Clive “Lizard” Williams.

The “Dancehall Hero” deejay is now on trial for the murder of Burton, who is a St. Catherine promoter/businessman. His trial for Williams’ death is set for November.

Nigel Thompson and Lenburgh McDonald are also jointly charged with Vybz Kartel for Burton’s murder.

According to official police report, Burton was shot and killed on July 12, 2011 along Walkers Avenue, in Gregory Park, St. Catherine while standing with a group of friends.

So far one woman testified that she heard the gunshot and discovered Barrington Burton’s lifeless body.

If convicted Vybz Kartel and his co-accused could face life in prison.

Update:
Court has adjourned for the day and will resume tomorrow where Justice Bryan Sykes will continue hearing arguments from the prosecution and defense regarding a motion to have a witness statement be entered into evidence.
